Southpaw Media LLC (“Southpaw Media”, “we”, “our”, “us”) is committed to protecting the privacy of our clients, their end users, and visitors to our website. This Privacy Policy explains how we collect, use, disclose, and safeguard personal and sensitive information when you:

  • engage any of our services (consulting, strategy, marketing, CRM/automation, white-labeled software platforms such as GoHighLevel),

By using our website or services, you consent to the practices described in this policy.

This policy covers all services and activities of Southpaw Media LLC, including but not limited to:

  • Marketing & lifecycle strategy, consulting, audits, and advisory services

  • Campaign design and execution across channels (email, SMS, automation, etc.)

  • Training, workshops, staffing, and expert services

  • White-label platform resale / access (e.g. GoHighLevel)

  • All client-data processing, data storage, and any information collected through or arising from our work

It applies to all individuals whose data we may collect: clients (businesses); their end users (customers, patients, students, etc.); and visitors to our website.

 

2. Legal & Regulatory Frameworks

Because we serve clients in regulated sectors (healthcare, higher education, finance) and are based in Texas, we comply with:

  • Texas Data Privacy and Security Act (TDPSA) — effective July 1, 2024. Grants Texas consumers rights over their personal data.

  • HIPAA (Health Insurance Portability and Accountability Act) — applies when we work with healthcare clients and handle Protected Health Information (PHI).

  • FERPA (Family Educational Rights and Privacy Act) — applies when we work with higher-education institutions and handle student education records.

 

3. What Data We Collect

We may collect:

  • Contact information: names, emails, phone numbers, business addresses

  • Account details: usernames, authentication credentials for systems we configure or manage on your behalf

  • Marketing/engagement data: email/SMS interactions, analytics, opt-in preferences, form submissions

  • Billing information: invoicing details, payment history (processed through secure third-party processors; we do not store full payment card numbers)

  • Sensitive data (when applicable): PHI for healthcare projects, student education records for higher-education clients, or limited financial data for finance sector engagements

 

4. How We Use Data

We use information to:

  • Provide contracted services (consulting, automation setup, campaign execution, reporting)

  • Manage client accounts, invoices, and support requests

  • Operate and improve our website and services

  • Deliver communications on behalf of our clients in compliance with consent and opt-in rules

  • Meet legal and regulatory requirements under TDPSA, HIPAA, and FERPA

We limit use of PHI and student records to the minimum necessary, consistent with HIPAA’s and FERPA’s requirements.

 

5. Texas Data Privacy & Security Act Provisions

As a Texas-based company:

  • Texas residents may request access to, correction of, or deletion of their personal data, and may opt out of targeted advertising, profiling, or sale of personal data.

  • Requests can be submitted to privacy@southpaw.media. We will respond within the timeframes required by TDPSA.

  • We maintain reasonable administrative, technical, and organizational safeguards to protect consumer data.

 

6. Sharing & Disclosure

We may share information with:

  • Clients — we act as a processor and do not claim ownership of client data.

  • Vetted service providers — including hosting partners, email/SMS platforms (such as GoHighLevel), analytics vendors, and payment processors.

  • Legal authorities — when required by law.

For healthcare clients, we sign Business Associate Agreements (BAAs).
For higher-ed clients, we comply with FERPA restrictions on disclosure of student records.

 

7. Data Security

Our safeguards include:

  • Encryption in transit (TLS/SSL) and encryption at rest where possible

  • Access controls with least-privilege permissions and multi-factor authentication

  • Regular monitoring of infrastructure security

  • Incident response and breach notification protocols

 

8. Data Retention

We retain data only as long as required for the purpose collected or as required by law. Client project data may be deleted or anonymized upon request after contract completion.

 

9. Data Subject Rights

Individuals may exercise their rights under TDPSA, HIPAA, and FERPA by contacting us at privacy@southpaw.media. These rights may include access, correction, deletion, restriction of processing, and portability (where applicable).

 

10. Cookies & Tracking

Our website uses cookies and analytics tools to improve site performance and user experience. Non-essential cookies can be managed through your browser settings.

 

11. Minors

Our services are not directed at minors, except where we are engaged by higher-education institutions. In those cases, FERPA rules apply to student records, and we act as a service provider under the school’s direction.

If client or end-user data is transferred outside the U.S., we use secure hosting providers and apply appropriate safeguards.

 

13. Breach Notification

If a breach occurs, we will notify affected clients and/or individuals as required by Texas law, HIPAA, and FERPA within the legally mandated timeframes.

 

14. Updates

We may update this policy as regulations evolve. Any significant changes will be posted on our website and communicated to clients before they take effect.

  • If you provide your phone number, you consent to receiving SMS messages related to your engagement with Southpaw Media or our clients.

  • Message frequency will vary based on your preferences and the nature of services.

  • Standard message and data rates may apply.

  • You may opt out at any time by replying STOP; you may request help by replying HELP.

  • We do not sell personal data, including phone numbers, to third parties.

  • SMS services comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and state privacy laws, including the California Consumer Privacy Act (CCPA/CPRA).

  • California residents have additional rights under CCPA/CPRA, including the right to know, delete, and opt out of the sale or sharing of personal data.
